- CD-ED feels that your privacy and security of your privacy is important to you. Thus, in accordance with relevant and applicable statutes, we advise you that we are not allowed to collect from you, any information other than your name, job title and your business address or business telephone number (as opposed to your personal address and telephone number) without your consent. You have the right to decide whether to provide personal information to us and if so, whether we can collect and retain such information.
- As well, as with all decisions, one must be competent as defined by law, to make such decisions such as providing consent.
- By indicating below your consent, you are representing that you are the person so identified by the information you have provided, and that you are at least 19 years of age or older (and where outside the province of Nova Scotia, where other ages of majority may apply, that you are at least the age of majority for the province in which you normally reside and from which you have gained access to this internet site).
- CD-ED also recognizes that it is important for anyone granting consent that they be informed of the use of any information so that such consent is informed consent. CD-ED herein undertakes not to use any of the information that has been provided by you through this internet site or to CD-ED’s agents or employees for any purpose other than to provide information to you as it relates to CD-ED’s courses or products, including your addresses, email addresses, telephone numbers, etc. for CD-ED’s staff for that purpose.
- You may choose not to provide any personal information to CD-ED simply by not providing consent as noted below. If you do provide such information, the information will be disclosed to the staff of CD-ED, including for the purpose of obtaining and compiling statistical data, which if disclosed to third parties will not disclose any of the personal information as it may relate to you or others, except as set out in paragraph 9 below.
- In accordance with the relevant and applicable legislation, CD-ED has designated employees to deal with any requests for personal information or inquiries from individuals with respect to their personal information. That position in our organization is the Marketing Manager. In accordance with our obligations concerning personal information and our control of that information, upon confirmation that any requests have been made by the individual whose information we have collected, CD-ED will, upon receipt of a written request (in accordance with applicable legislation) furnish to any individuals, the personal information that CD-ED has in its possession with respect to that individual. If you are interested in making such a request, please contact the Marketing Manager of CD-ED who will assist in that regard. Upon receipt of such a request, CD-ED will respond with all due diligence and will endeavor to satisfy that request within 30 days, following receipt of that written request, barring unforseen circumstances, which would unduly interfere with the organization’s operations, in which case such request would be carried out within a further 30 day period.
- The personal information that we collect will be stored in a data form and we will follow reasonable technical and management practices to help protect the confidentiality, security and integrity of the data stored in our system. While no computer system is completely secure, we believe the measures implemented by our website and staff, reduce the likelihood of security problems to a level appropriate to the type of data involved.
- Any data kept and requested will be provided to you on request, as noted in paragraph 6 above in a readily, comprehensible form.
- Other than internal use by CD-ED employees, as is noted above, any of the personal information provided to CD-ED by yourself will not be disclosed without your knowledge or consent unless it meets one of the following criteria, which have been recognized as statutory exemptions to that prohibition:
- To a Barrister or Solicitor representing CD-ED.
- In order to facilitate the collection of a debt owed by the individual providing such information to CD-ED.
- In response to a subpoena, summons, warrant or order from a Court, a person or a body with the power to compel the production of records or is made to comply with the rules of Court concerning disclosure of records.
- To a government institution or part thereof that has sought the information, identified it’s legal entitlement to receive same and has advised CD-ED that:
- It suspects the requested information relates to a matter of national security, national defense or international relations.
- Disclosure to it is necessary in order to enforce any law of Canada, a Province or a foreign jurisdiction, to conduct an investigation relating to the enforcement of such a law or to gather intelligence in order to facilitate such enforcement or.
- Disclosure is being sought to facilitate the administration of any law of Canada or Province.
- At CD-ED’s own initiative to an investigative body or a government institution or part thereof where CD-ED:
- Reasonably believes the information pertains to a prior, ongoing or perspective breach in agreement or a contravention of the laws of Canada, a province or a foreign jurisdiction or
- Suspects that the information relates to Canada’s national security, national defense or to the conduct of international affairs.
- To a person who requires the said information to address an emergency threatening the life, health and security of an individual, subject to the condition that if the subject of the personal information is alive, CD-ED must, without delay, inform the individual in writing about the disclosure.
- For statistical or scholarly study or research, purposes that would be thwarted, but for disclosure, if it’s impractical to obtain consent and the Privacy Commissioner is advised of disclosure before it occurs.
- To an institution that conserves records of historic or archival character, and the disclosure is made in the interests of conservation.
- After the earlier of 100 years after the record containing the information was created or 20 years after the death of the individual to whom the information pertains.
- Only in respect of publicly available information specified in the regulations.
- By an investigative body, acting reasonably, for purposes relating to the investigation of a breach of agreement or the contravention of the laws of Canada or a province or.
- Or to comply with the law.
- Our duty to provide information to you includes, where the law or Court Order allows, information to you with respect to any requests that have been made by others with respect to information pertaining to you and your personal information, subject to our obligations by statute to notify the institution or part thereof that has made the request and our statutory duty to allow them 30 days there from to make a response.
- If on notice, we provide information to you with respect to your personal information that you provided, and you demonstrate that the information is inaccurate or incomplete, we will amend the record as required. Similarly, should there be any change in your personal information, and you wish to advise us of same, we will accordingly amend or revise our records accordingly.
- If you have any further questions with respect to privacy or collection of personal information, please contact our Marketing Manager, as he is designated to respond to such requests. This policy may be revised and will be noted accordingly. The policy herein was implemented and effective as of October 23, 2006.
